cant connect 03 usdm wrx

I have a brand new tactrix cable 2.0 and a eee pc netbook running windows 7 and the latest Version 1.42.2595 ecuflash

I have successfully connected to an 02 usdm wrx, but now I have tried my brothers 03 and I get this error:

Check the ECU is in test mode (1 or 2 sets of test mode connectors to join). Fans should cycle with key on.

it was in test mode. I am pretty sure the ecu was previously loaded with ECUTek and locked. I ordered another OEM ecu on ebay.
